When the California Gold Rush began in 1848, many men decided to travel down to the gold fields. Some of these men were drafted into the military, and some became mercenaries. One man who decided to join the army was James Fenton. Fenton was a miner who had also become interested in politics and wanted to make a difference for his community. He joined up with the militia and fought in various skirmishes until he was called back to duty in 1851 as a sergeant in Company A of the 1st Battalion, Sacramento Infantry Regiment. Fenton served his country faithfully until 1861 when he resigned from the army because he felt that his involvement with slavery violated Army regulations. After resigning from service, Fenton took up law enforcement work as an officer with the Berkeley Police Department. In 1875, he left Berkeley for good and started practicing law full-time in San Francisco. In 1892, James Fenton married Jane Addams and they moved back to Berkeley where they continued their legal practice together until Jane's death in 1948. In 1949, Jim Fenton was inducted into The American Lawyer's Hall of Fame (ALHOF). In 1977, he received an honorary Doctorate from UC Berkeley School of Law. In 1984, Jim Fenton died at age 89 years old after a long battle with leukemia.

The first permanent European settlement in what is now Berkeley was made on February 2, 1772 when Mission Dolores Spaniard José de Alvarado and his party arrived on horseback from Gascony.
