The Berkeley National Guard was organized on December 12, 1889. The original unit was the 5th Infantry Regiment. It was redesignated as the 8th Infantry Regiment on October 1, 1903. The regiment was redesignated again as the 9th Infantry Regiment on November 1, 1907 before becoming the 10th Infantry Regiment in 1912. The regiment became a battalion-sized institution and changed its name to the Berkeley National Guard Battalion on February 26, 1915 before reverting to its original name of the 5th Infantry Regiment on May 25, 1916.

The University of California at Berkeley (UC Berkeley) is one of America's most prestigious universities. The city was founded by Puritan settlers in 1777 as an agricultural settlement on an eminence overlooking Point Park Lake. In 1969–70 two large demonstrations were held against Ulysses S Grant's presidency; one occurred during finals week at UC Berkeley while other protests took place throughout campus daily throughout that year. These protests came to be known as "The Day of Rage." After this experience many students turned their backs on protest tactics and instead embraced a strategy called "restraint" which aimed to prevent physical confrontations between demonstrators and police officers while also preserving civil rights principles such as free speech and peaceful assembly. This strategy failed to achieve any significant changes until recent years when protesters have chosen more aggressive tactics which have resulted in multiple arrests and injuries to both demonstrators and police officers
