The first permanent settler in what would become Clayton was David Wilcox on November 17, 1847. The town was founded on land ceded to him by Rancho San Borro Mexican grantee Manuel Nieto during the Alta California period of Spanish rule over most of Southern California. When American soldiers burned down Nieto's holdings north of present day Upland about two miles east ofpresent day Clayton on December 3, 1848, cattle drives stopped at that location andneyed settlers into what became known as "the Old Town" or "Old Clayton". On February 2, 1850 Mexican General Antonio Lopez y Costilla granted ownership of all lands within a radius of 20 miles from San Francisco to José María Escobar who had married Dovey Cobb; thus forming present day Kern County with its six townships: San Bernardino (northwest), Menifee (east), Modoc (northeast), Saugus (southwest), Ripon(southeast) and Placer Heights(west). In 1859 it was announced that an Act had been passed by Congress providing for annexation by the State of California as part of their efforts to gain statehood following the admission into Confederation of America of both Mexico and Oregon which did not take place until 1850.
